DOVE® CHOCOLATE PROMISES MESSAGE SUBMISSION TERMS

ELIGIBILITY: You must be at least 18 years old and the age of majority in the jurisdiction where you reside to participate in the DOVE® Chocolate Promises Message Submission Program (“Program”).

HOW TO PARTICIPATE: Go to dovechocolate.com and follow the onscreen instructions to register. After you complete your registration, submit a PROMISES message with your favorite aspiration (your “Promises Message”).

PARTICIPATION TERMS: By submitting your Promises Message, you understand and agree that:

Your Promises Message is your original work and was not previously published;
You have the unrestricted right to submit your Promises Message;
Your Promises Message is not for any illegal, infringing, offensive or otherwise improper purpose;
Your Promises Message does not:
- include any business names or logos, brand names, characters or slogans other than those relating to the DOVE® Chocolate brand;
- disparage or make unsubstantiated claims about any third party or its products or services;
- contain any virus, bug, worm or other corruptive code; or
- include or include links to advertisements, commercial solicitations or spam.
You understand that Mars Wrigley Confectionery US, LLC and its affiliates (“Mars”) may, in its sole discretion, print your Promises Message on packaging to promote the DOVE® Chocolate brand. YOU GRANT MARS THE PERPETUAL, WORLDWIDE, ROYALTY-FREE, NON-EXCLUSIVE, IRREVOCABLE AND TRANSFERABLE LICENSE TO USE, REPRODUCE, MODIFY, PUBLICLY DISPLAY, PUBLICLY PERFORM, SUBLICENSE AND DISTRIBUTE YOUR PROMISES MESSAGE (IN WHOLE OR IN PART AND IN ANY MEDIA) FOR MARS’ PROMOTIONAL PURPOSES TO THE EXTENT PERMITTED BY LAW WITH OR WITHOUT NOTICE OR CREDIT TO YOU. Except for the rights granted to Mars in these Terms, you shall continue to own all rights in and to your Promises Message.
You are not entitled to compensation for your Promises Message. Mars shall retain all revenue generated from advertising, publicity, promotional materials or distribution rights in connection with your Promises Message and the rights granted by you in these Terms;
Mars retains all right, title and interest in and to all business names, logos, brand names, characters and slogans associated with the DOVE Chocolate® brand;
You understand that these Terms are a legal agreement between Mars and you. YOU WARRANT THAT YOU ARE ELIGIBLE TO PARTICIPATE IN THIS PROGRAM AND TO AGREE TO THESE TERMS; and
BY SUBMITTING YOUR CONTENT, YOU AGREE TO RELEASE MARS AND ITS AFFILIATES, AGENTS AND ADVERTISING AND PROMOTION AGENCIES (COLLECTIVELY, “MARS PARTIES”) FROM ALL LIABILITY, LOSSES OR DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR CONTENT.

GENERAL PROGRAM TERMS: THIS PROGRAM IS AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND. The Mars Parties are not responsible for: late, lost, incomplete, misaddressed or misdirected email; errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information caused by technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; use of your Promises Message by third parties; data corruption, theft, destruction, unauthorized access to or alteration of Program materials; or any other cause outside Mars’ reasonable control. Mars also may modify, terminate or suspend this Program if it cannot be executed as intended. If any provision of these Terms is held to be invalid or unenforceable, all remaining provisions remain in full force and effect. This Program is void where prohibited, restricted or taxed. This Program is subject to all applicable laws, rules and regulations.

ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS FOR WHICH THE MARS PARTIES RESERVE THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
